5. User Content and Intellectual Property

You retain ownership of all content you create, upload, or submit to our Service ("User Content"). By using our Service, you grant IDEQO a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to:

• Make backup copies for security and performance purposes

You represent and warrant that your User Content does not violate any third-party rights or applicable laws. You agree to indemnify IDEQO against any claims arising from your User Content.

6. AI-Generated Content

Our Service uses artificial intelligence to help generate content suggestions and assist with content creation. You acknowledge and agree that:

• AI-generated content is provided "as is" without any warranties
• You are solely responsible for reviewing, editing, and verifying all AI-generated content
• IDEQO makes no guarantees regarding the accuracy, completeness, originality, or quality of AI-generated content
• You assume all risks associated with using AI-generated content
• IDEQO shall not be liable for any consequences arising from your use of AI-generated content

7. Prohibited Uses

You agree not to use the Service to:

• Create content that is illegal, harmful, threatening, abusive, defamatory, or discriminatory
• Violate any intellectual property rights or other proprietary rights
• Engage in spam, fraud, deceptive practices, or any unlawful activities

• We may delete your account and data after the 30-day period
• All licenses granted by you to IDEQO will survive termination
• No refunds will be provided for any unused subscription fees

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDEQO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL IDEQO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim or $100, whichever is less.

12. Indemnification

You agree to defend, indemnify, and hold harmless IDEQO, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.

13. Changes to Terms

We reserve the right to update these Terms at any time without prior notice. We will post the updated Terms on our website with a new "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except for claims that may be brought in small claims court.

You waive any right to a jury trial and agree that any arbitration will be conducted on an individual basis only and not as a class action or representative action.
